Special needs trusts in Texas

If someone you love has a disability, an inheritance left to them directly could cost them SSI or Medicaid benefits. A special needs trust lets you provide for their comfort and quality of life while preserving eligibility for the benefits they rely on.

Types of special needs trusts

  • Third-party trust. Funded by parents, grandparents or others with their own money. Usually part of the family’s estate plan. No Medicaid payback is required at the beneficiary’s death.
  • First-party trust. Funded with the beneficiary’s own assets, such as a lawsuit settlement or a direct inheritance. Federal law requires repaying Medicaid from what’s left at the beneficiary’s death.
  • Pooled trust. Managed by a nonprofit, often an option for smaller amounts or when no family trustee is available.
